1. Who we are
Fairmetric Testlabs is a trading name of Gaminglabs International Ltd, a company registered in the Republic of Mauritius (company number to be confirmed). In these documents, “Fairmetric”, “we”, “us” and “our” mean Gaminglabs International Ltd, trading as Fairmetric Testlabs. You can contact us at [email protected].
We are the controller of the personal data described in this notice. We process personal data in line with the Data Protection Act, 2019 of Kenya and, where it applies, the Data Protection Act 2017 of Mauritius and other applicable data protection laws.
2. The short version
- The site does not use analytics, advertising or tracking cookies.
- We collect personal data only when you contact us, and use it only to respond and to manage our relationship with you.
- We do not sell personal data, and we do not use it for automated decision-making.
3. What we collect
| Data | Where it comes from | Why we use it | Lawful basis |
|---|---|---|---|
| Name, company, email, phone, the service and markets you are interested in, and your message | You, when you email us or use the quote form (which opens your own email app) | To answer your enquiry, prepare a quote and manage any engagement that follows | Your consent, and steps taken at your request before entering into a contract |
| Correspondence with you | You and us | To keep a record of what was agreed and to resolve questions or complaints | Our legitimate interest in running the business and meeting legal obligations |
| Technical data such as IP address, browser type and request time | Your browser, recorded by our hosting provider and the third-party services listed below | To deliver the site securely and protect it from abuse | Our legitimate interest in operating a secure website |
Please do not send us source code, game data or other confidential material through the quote form or by unsolicited email. We will agree a secure way to exchange it once an engagement is in place.
4. Who we share it with
We share personal data only where needed, with:
- Cloudflare, Inc., which hosts the site and protects it from attacks;
- Unsplash and Pexels, which serve some photographs. When your browser loads these, the provider receives your IP address and browser details;
- our email provider, which stores the correspondence you send us;
- professional advisers, regulators, accreditation bodies, courts or law enforcement, where we are legally required to or need to establish or defend a legal claim.
5. International transfers
Some of these providers process data outside Kenya. Where they do, we rely on the safeguards permitted by the Data Protection Act, 2019, such as the provider's contractual commitments, and transfer only what is needed.
6. How long we keep it
Enquiries that do not lead to an engagement are deleted within 24 months of our last contact. Records relating to an engagement are kept for as long as the engagement lasts and then for the period our quality system, accreditation requirements and the law require, normally up to seven years.
7. Your rights
Under the Data Protection Act, 2019 you have the right to:
- be informed about how your personal data is used;
- access the personal data we hold about you;
- object to processing of all or part of it;
- ask us to correct false or misleading data;
- ask us to delete data that is false, misleading or no longer needed;
- withdraw consent at any time, without affecting processing already carried out;
- receive your data in a portable format, where this applies.
To use any of these rights, email [email protected]. We will respond within the time the law allows. If you are not satisfied with our response, you can complain to the Office of the Data Protection Commissioner in Kenya, or to the data protection authority where you live.
